Providing tough representation against arson charges
Arson is a broad offense, encompassing a variety of actions. Maryland law generally classifies arson offenses into four categories:
- First-degree arson. This is defined as willfully and maliciously setting fire to a dwelling or structure where a person is present. It is the most serious classification of arson charges, with a potential punishment of 30 years in prison and a fine up to $50,000.
- Second-degree arson. This is defined as willfully and maliciously setting fire to a structure that belongs to someone else, such as a neighbor’s unoccupied garage. A conviction could result in 20 years in prison and a fine up to $30,000.
- First-degree malicious burning. Malicious burning applies to personal property, instead of a building or structure. It is defined as willfully and maliciously setting fire to the personal property of another person. For example, setting fire to a person’s mailbox may result in a malicious burning charge. The amount of damage must be greater than $1,000 for the first-degree classification, and the potential punishment is up to five years in jail, along with a fine of $5000.
- Second-degree malicious burning. If the value of the personal property burned is $1,000 or less, the malicious burning charge is classified as second degree. The potential penalty for this misdemeanor offense is up to 18 months in jail and a $500 fine.
Arson with the intent to defraud and threats of arson can also result in criminal charges. Whether you are facing a malicious burning charge or a first-degree arson accusation, it’s important that you secure the services of a knowledgeable Annapolis arson defense attorney with the chops to take on tough cases in the Maryland courts.
